Kohala Warranty

Kohala instruments are warranted to be free from defects in materials and workmanship for the life of the original retail purchaser, subject to the limitations contained in this warranty.

If at any time your Kohala instrument malfunctions as a result of faulty materials or workmanship, KHS America (Parent Company of Kohala) will repair the defect(s) or replace the instrument, as it deems appropriate at its sole discretion. Factory Installed Electronics are covered for One (1) year from the date of the original purchase. KHS America reserves the right to use materials regularly utilized at the time of repair in the event that original materials are no longer available. If replacement of your instrument is deemed appropriate by our staff, KHS America will replace the instrument with one of the same or most similar style of a value not in excess of the original purchase price of your instrument.

In the unlikely event that your instrument is destroyed, lost or damaged beyond repair, while in the possession of KHS America for repair, KHS America will replace that instrument with one of the same or most similar style of a value not in excess of the original purchase price of your instrument. Any insurance covering the instrument, including but not limited to collector’s value insurance, must be carried by owner at owner’s expense.

THIS WARRANTY IS EXTENDED TO THE ORIGINAL RETAIL PURCHASER ONLY AND IS NON-TRANSFERRABLE. IN ORDER TO VALIDATE YOUR WARRANTY, YOUR PROOF OF PURCHASE OR SALES RECEIPT MUST ACCOMPANY ALL REQUESTS FOR WARRANTY COVERAGE.

 

This Warranty Is Subject To the Following Limitations

THIS WARRANTY DOES NOT COVER:

  1. Any instrument that has been altered or modified in any way or upon which the serial number has been tampered with or altered.
  2. Any instrument that has been damaged due to misuse, negligence, improper maintenance, improper operation, and accidental damage of any kind.
  3. The subjective issue of tonal characteristics.
  4. Normal wear and tear (i.e; worn frets, worn machine heads, worn plating, string replacement, or damages to or discoloration of the instrument finish for any reason).
  5. Any instrument that has been purchased from an unauthorized dealer, or upon which unauthorized repair or service has been performed.
  6. Any gig bag or case.

KHS America makes no other express warranty of any kind whatsoever. All implied warranties, including warranties of merchantability and fitness for a particular purpose, exceeding the specific provisions of this warranty are hereby disclaimed and excluded from this warranty.

**Customers who purchased product outside the U.S should contact their local distributor for the handling and resolution of all warranty issues as the above-described KHS America Warranty is not applicable.

 

How to Obtain Warranty Service

(b) Write the return authorization number in a conspicuous place on the outside of the return shipping carton. Note: The return will be refused if there is not a KHS America issued return authorization number clearly on the outside of the return shipping carton.

The owner of the product must prepay all freight and insurance charges when returning the product.

(c) Once KHS America is contacted and an return authorization number is issued, carefully box the product (preferably in the original carton or) in an approved shipping carton; and then ship the product, freight and insurance prepaid, to KHS America 12020 Volunteer Blvd. Mt. Juliet, TN 37122 Enclose a copy of the original sales receipt plus a letter of explanation of the problem.

Make sure the letter includes INSTRUMENT MODEL NUMBER, YOUR NAME, TELEPHONE NUMBERS (Cell & Home as applicable), EMAIL ADDRESS and of course your FULL RETURN ADDRESS.

 

LIMITED WARRANTY LIMITATIONS AND DISCLAIMERS

KHS America DISCLAIMS ALL OTHER EXPRESS WARRANTIES. All IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY. HOHNER, INC. SHALL NOT BE LIABLE FOR ANY LOSS OF USE OF THE PRODUCT, ANY INCONVENIENCE, ANY OTHER LOSS, ANY LOST PROFITS, OR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING IN WHOLE OR IN PART OUT OF OR IN CONNECTION WITH THIS LIMITED WARRANTY, OR THE BREACH OF THIS LIMITED WARRANTY, OR THE USE THEREOF. KHS America’s sole and exclusive responsibility shall be as provided under this Warranty and, UNDER NO CIRCUMSTANCES, SHALL KHS America BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES. THIS LIMITED WARRANTY IS YOUR EXCLUSIVE REMEDY AND IS MADE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED; ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY EXPRESSLY LIMITED IN DURATION TO THE DURATION OF THIS WRITTEN WARRANTY.

PERFORMANCE OR MAINTENANCE OF THIS PRODUCT. Some states do not allow the exclusion of incidental or consequential damages or limitations on how long an implied warranty lasts, so these limitations or exclusions may not apply to you. This Limited Warranty gives you specific legal rights. You may also have other rights that vary from state to state. This Limited Warranty does not cover any representation or warranty made by any person, including any KHS America dealer or any employee of KHS America beyond the provisions of this Limited Warranty.
